Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Fishableai.app mobile application (the "App") operated by Fishableai.app, LLC ("Fishableai.app," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.
1. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. License to Use the App
Subject to your compliance with these Terms, Fishableai.app grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device solely for your personal, non-commercial use.
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or attempt to extract the source code of the App
- Use the App to build a competing product or service
- Access the App through automated means such as bots, scrapers, or crawlers
- Remove or obscure any proprietary notices or labels on the App
3. The Fishing Reports — Important Limitations
3.1 Nature of the Content
The fishing reports, conditions scores, tide information, weather summaries, and all other content provided through the App (collectively, "Report Content") are generated using artificial intelligence, publicly available data sources, and third-party APIs. Report Content is provided for general informational and recreational purposes only.
3.2 Not Professional Advice
Report Content does not constitute professional maritime safety advice, navigational guidance, or recommendations from a licensed captain or marine professional. You should always:
- Check official NOAA weather forecasts and marine warnings before any boating trip
- Monitor VHF marine radio (Weather Radio, Channel 16) for current conditions
- Use your own judgment regarding the safety of any marine excursion
- Follow all applicable US Coast Guard regulations and safe boating practices
3.3 Accuracy Disclaimer
We make no representations or warranties about the accuracy, completeness, timeliness, or reliability of Report Content. Fishing conditions, weather, and tidal data can change rapidly. Local fishing report summaries are derived from AI analysis of publicly available sources and may not reflect current conditions.
Never rely solely on Fishableai.app to make decisions about your safety on the water. Marine conditions can change rapidly and unpredictably. Always check official government weather sources and use your own judgment. Fishableai.app is a fishing intelligence tool, not a safety system.
4. User Conduct
You agree to use the App only for lawful purposes. You agree not to:
- Use the App for any fraudulent or unlawful purpose
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Interfere with or disrupt the integrity or performance of the App
- Transmit any harmful or disruptive content through the App
5. Third-Party Content and Services
The App aggregates content from third-party sources including tackle shop blogs, fishing guides, weather APIs, and tide data providers. We do not endorse, control, or guarantee the accuracy of third-party content. The App depends on third-party APIs for core functionality. We do not guarantee uninterrupted availability and are not liable for interruptions caused by third-party service failures.
6. Intellectual Property
The App and its original content, features, and functionality are owned by Fishableai.app, LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. The "Fishableai.app" name, logo, and associated marks are trademarks of Fishableai.app, LLC. You may not use our trademarks without prior written consent.
Content you share from the App (such as the daily report share card) may be shared for personal, non-commercial purposes. Commercial use of App-generated content requires our written permission.
7. Disclaimer of Warranties
THE APP AND ALL REPORT CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FISHABLEAI.APP DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or secure, or that results of using the App will meet your requirements.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FISHABLEAI.APP, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill
- Personal injury or property damage arising from your use of or reliance on the App
- Any interruption or cessation of App availability
- Any bugs, viruses, or harmful code transmitted through the App
IN NO EVENT SHALL FISHABLEAI.APP'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100.00). Some jurisdictions do not allow certain liability limitations — in such jurisdictions our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Fishableai.app, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party right.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, if we reasonably believe you have violated these Terms. You may stop using the App at any time by deleting it from your device. Sections 6, 7, 8, 9, and 11 survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any dispute shall first be subject to good-faith negotiation. If unresolved within 30 days, it shall be submitted to binding arbitration in Sarasota County, Florida under American Arbitration Association rules. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights. All disputes shall be resolved individually — no class actions.
12. Apple App Store Additional Terms
If you download the App through the Apple App Store:
- These Terms are between you and Fishableai.app only, not with Apple Inc.
- Apple has no obligation to furnish maintenance or support for the App
- Apple is not responsible for addressing any claims relating to the App
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
13. General Provisions
If any provision of these Terms is found unenforceable, the remaining Terms remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fishableai.app regarding the App.
